Applicable to all vehicle rentals in Bonaire and Curaçao.
 

1. Agreement Overview

By renting from Moke Bonaire & Curaçao io (the “Company”), you agree to the terms below. The vehicle remains property of the Company at all times. Unauthorized subleasing, transfer, or modification of this agreement is not permitted. No warranty - express or implied - is provided.
 

2. Authorized Operators

Only registered renters and approved additional drivers (with valid licenses and a minimum age of 18) may operate the vehicle. Renters under 25 are subject to an underage fee. All drivers share full responsibility for obligations and damages under this agreement.
 

3. Vehicle Return

The renter must return the vehicle in the same condition as received, ordinary wear excepted, by the agreed date and time. Failure to do so may incur additional daily charges. Excessive cleaning will incur a minimum USD 75 fee.
 

4. Liability & Damage Responsibility

The driver and renter are fully liable for any and all costs arising from damage, collision, or loss to the vehicle, regardless of fault, unless otherwise required by local law. This includes repair costs, towing, storage, loss of use, administrative fees, and any associated third-party damage.

In the event of damage, collision, or accident, the driver must immediately inform the Company and local authorities and cooperate fully with investigations. Failure to report or comply may result in full liability for all damages.
In all cases of damage or collision, the driver will be fully responsible for the resulting costs.
 

5. Prohibited Use

• Unauthorized drivers operating the vehicle.

• Transporting passengers or goods for hire.

• Driving under the influence of alcohol or drugs.

• Off-road driving or operating on unpaved or sandy terrain.

• Using the vehicle in any race, test, or illegal activity.

• Overloading the vehicle or carrying hazardous materials.

Any prohibited use will void protections and result in full financial liability for all related damages or costs.
 

6. Payment & Charges

All charges are due at rental completion. The Company may pre-authorize up to 50% above the estimated amount on your credit card. Late returns or unpaid balances may incur additional fees. All fines, tolls, or tickets incurred during the rental are your responsibility.
 

7. Fuel Policy

Return the vehicle with the same fuel level as at delivery. Missing fuel will be charged per local replacement rate, plus service cost. Prepaid fuel purchases are non-refundable.
 

8. Personal Property

Moke Bonaire & Curaçao io is not responsible for loss or theft of personal belongings left inside the vehicle or on company premises.
 

9. Traffic Laws & Local Regulations

• Familiarize yourself with Bonaire or Curaçao traffic laws before driving.

• Seat belts are mandatory for all occupants.

• Smoking is not permitted inside vehicles (cleaning fee USD 250).

• Lost keys incur a USD 300 replacement charge.

• The “keys locked inside” clause is not applicable.

Any damage caused by traffic violations, negligence, or unauthorized road use will result in full liability for the driver and renter.
 

10. Liability Protection

The Company provides third-party liability protection only to the extent required by local law in Bonaire or Curaçao. This coverage is primary relative to any insurance held by the renter or authorized operator. If additional liability protection is required by law, it will be at the statutory minimum.
 

11. Accidents, Theft & Vandalism

All accidents, thefts, or acts of vandalism must be immediately reported to both the Company and local police. The renter must provide all relevant details, including witness statements and insurance information.
Failure to cooperate or report properly may result in the renter being fully liable for all resulting damages, repairs, or losses.
 

12. Limits on Liability

The Company shall not be liable for indirect, special, or consequential damages (including lost profits) arising out of the rental, use, or inability to use the vehicle, even if the Company has been advised of such possibilities.
 

13. Parking & Traffic Violations

The renter is responsible for all parking and traffic fines, impound fees, and penalties incurred during the rental period. Failure to pay fines promptly may result in additional administrative charges (minimum USD 10 per incident).
To avoid unnecessary fees, renters should settle fines directly with the issuing authorities.
 

14. Optional Services & Governing Law

Upgrades or changes after rental commencement are subject to additional charges.

This agreement is governed by the laws of the jurisdiction in which the rental originated (Bonaire or Curaçao). Any disputes arising under this agreement shall be handled under the exclusive jurisdiction of local courts.
